DMV Hearings
If your driving privileges have been revoked, or if you have received a notice from the Department of Motor Vehicles stating that your driving privileges are scheduled to be revoked, you may be entitled to a hearing to challenge the revocation.
DMV Refusal Hearings – Have you been charged with Driving While Impaired? Were you asked to take a breathalyzer test? Did you attempt to take the test, but were unfairly deemed to have refused the test? Your license will automatically be revoked for 1 year based on your refusal, and if you are convicted of DWI, you will have to wait six months before you will be eligible for a Limited Driving Privilege. There are many reasons as to why you may unable to produce a sufficient breath sample. Maybe you were nervous and upset. Maybe you have Asthma. Maybe the test was not administered properly. Maybe the breathalyzer machine was malfunctioning.
If the officer claims that you refused to submit to a breath test, and you believe this to be false, you may be eligible for a Refusal Revocation Hearing at the Department of Motor Vehicles. It is imperative that you contact us immediately regarding your rights, as there is a limited time frame in which to request a hearing. At a refusal hearing, the arresting officer will present evidence of what happened prior to your arrest and what happened when you were asked to submit to the breath test. DMV Restoration Hearings – If you’ve been convicted of three charges of Driving While Impaired, your North Carolina driving privileges are permanently suspended. However, after a period of time, you may be eligible for a DWI Restoration Hearing. To qualify for a DWI Restoration Hearing, certain evidence must be submitted, such as proof of compliance with substance abuse treatment and other criminal and driving records.
